Wecard Terms & Conditions

The wearepoint.net solution (the solution), allows companies and consumers to create an assigned account in order to provide, in complete autonomy and in real time, a series of services to citizens such as, for example, telephone recharges, vouchers, giftcards, payment of utilities, e-shops. From the above account it is indeed possible to create, accept and finance accounts and cards and use them to make online purchases, share money between paybills community members, make utilities payments or simply receive benefit on purchases made on conventioned partner sites (Cashback).

The Solution consists of a software application, henceforth referred to as “Application” as well as certain regulated payment services henceforth referred to as “Payment Services” accessible to you through your direct access to a secure system for the exchange of personal and financial data henceforth referred to as the “Platform Services”.

To provide you with the Solution, it is necessary for each of the following parties (henceforth “Provider”) named in this agreement to form a direct contractual relationship with you in relation to the services they provide to you as part of your access and use of the Solution:

  • For the Application, you agree to enter into and be bound by the terms of the Application Agreement, which you can read here, with One Class Contract S.r.l. henceforth the “Application Provider”, Contrada Scarpara, SNC, 70024 Gravina in Puglia (BA) - Italy (P.IVA: 07979670721).

  • For the Payment Services, you agree to enter into and be bound by the terms of the Payment Services Agreement, which you can read here, with Paynetics AD , an electronic money institution regulated by the Bulgarian National Bank with whose company address is 76A James Bourchier, Sofia, Bulgaria (Registration No:131574695).

  • For Platform Services, you agree to enter into and be bound by the terms of the Platform Access and Data Processing Agreement, which you can read here, with Paystratus Group Ltd , whose company address is Kemp House 160 City Road, London EC1V 2NX, United Kingdom (Registration No:11677111).

Each of these parties is individually entitled to treat your use of the Solution as your acceptance of their respective terms and conditions, and to make a charge to you for their services which will be specified in their terms and conditions. You are advised to save a copy to your computer for future reference.

If there is any inconsistency between any of the provisions of these agreements, then, in relation to any inconsistency relating to the provision of Payment Services, the Payment Services Agreement shall prevail in preference to the other agreements, and the Platform Access and Data Processing Agreement shall prevail in preference to the Application Agreement.

For customers based in the European Union, the Payment Account and/or Mastercard cards as applicable are issued by Paynetics AD with company address 76A James Bourchier Blvd, 1407 Sofia, Bulgaria, company registration number 131574695. Paynetics AD is an electronic money institution authorised and regulated by the Bulgarian National Bank for the issuance of e-money and provision of payment services in the EU. Weavr (Europe) Ltd is acting on behalf of Paynetics AD, as a registered agent on the territory of the EU member states, and is entered into the public register of e-money institutions’ agents kept by the Bulgarian National Bank.

For customers based in the United Kingdom, the Payment Account and/or Mastercard cards as applicable are issued by Paynetics UK, Company number 1248133. Paynetics UK is a wholly owned subsidiary of Paynetics AD with its registered address at 1st Floor, 18 Devonshire Row, London, England, EC2M 4RH. Paynetics UK is an electronic money institution authorised and regulated by the Financial Conduct Authority (firm reference number 942777) for the issuance of e-money and provision of payment services in the UK. Weavr Ltd is a distributor of Paynetics UK on the territory of the UK.

Paystratus Group Limited provides software and support services to Weavr Ltd and Weavr Europe Ltd.

To ensure your funds are safe, Paynetics AD and Paynetics UK follow a process known as ‘safeguarding’ which is a regulatory requirement for all EMIs. In this process Paynetics AD, respectively Paynetics UK, keeps your money separate from its own (firm) money and places it in a safeguarding account with a Bank.

Electronic Money issued is not covered by any Deposit Guarantee Scheme which is a government backed scheme offering protection to customers’ funds of up to €100,000 in the EU (£85,000 in the UK under the FSCS) per customer. However, in the event of an insolvency, your funds would remain in the safeguarded account at the designated Bank and separated from Paynetics’ accounts and funds.
